1. Acceptance of Terms

NextPayments.cc is a subscription and recurring payment tracking and reminder service. Our service allows you to:

- Set customizable email reminders for upcoming payments
- Organize payments using tags and categories
- View payments across multiple currencies
- Export payment schedules to calendar applications (iCal format)
- Monitor payment history and due dates
What NextPayments.cc Is NOT:
- NextPayments.cc is NOT a payment processor or financial institution
- We do NOT handle, process, or transmit actual financial transactions
- We do NOT have the ability to cancel subscriptions on your behalf
- We do NOT contact merchants or service providers regarding your subscriptions
- We do NOT provide financial, legal, or tax advice
- We are NOT a substitute for professional financial management services
3. User Accounts and Registration
3.1 Account Creation
To use certain features of our service, you must register for an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security and confidentiality of your account credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized access or security breaches
3.2 Account Security
You are solely responsible for maintaining the confidentiality of your account login credentials. You agree not to share your account credentials with any third party. We are not liable for any loss or damage arising from your failure to maintain account security.
3.3 Account Accuracy
You represent and warrant that all information you provide to us is accurate, truthful, and complete. Providing false or misleading information may result in immediate termination of your account.
4. Service Scope and Limitations
4.1 What We Do
NextPayments.cc provides an informational tracking and reminder service. We help you organize and remember your recurring payment obligations by sending email notifications based on the schedules you configure.
4.2 What We Do NOT Do
CRITICAL DISCLAIMER:
- We do NOT cancel subscriptions. You must cancel unwanted subscriptions directly with the merchant or service provider.
- We do NOT verify payment information. We rely entirely on the information you enter into our system.
- We do NOT guarantee email delivery. Email delivery depends on third-party services and factors outside our control.
- We do NOT have relationships with your subscription providers. We cannot intervene in disputes or billing issues.
- We are NOT responsible for charges. You are solely responsible for managing your actual subscription payments and cancellations.
4.3 Service Availability
While we strive to maintain continuous service availability, we do not guarantee that:
- The service will be available at all times without interruption
- The service will be error-free or secure
- Defects will be corrected
- The service will meet your specific requirements
We reserve the right to modify, suspend, or discontinue the service (or any part thereof) at any time, with or without notice, for any reason including but not limited to maintenance, upgrades, or improvements.
5. User Responsibilities
5.1 Accurate Information Entry
You are solely responsible for the accuracy of all payment information you enter into the service, including but not limited to:
- Payment amounts
- Due dates
- Merchant or service provider names
- Payment frequencies (monthly, yearly, etc.)
- Currency selections
- Payment method associations
5.2 Acting on Reminders
You acknowledge and agree that:
- Receiving a reminder does NOT mean payment has been made
- You are responsible for taking action based on reminders
- You must independently verify all payment due dates
- You are solely responsible for canceling unwanted subscriptions
- Our service is a tool to assist you, not a substitute for your own diligence
5.3 Prohibited Uses
You agree NOT to use the service for any of the following purposes:
- Any unlawful purpose or in violation of any applicable laws
- To violate the rights of others, including privacy and intellectual property rights
- To transmit harmful code, viruses, or malicious software
- To attempt unauthorized access to our systems or other users' accounts
- To use automated systems (bots, scrapers) without our written permission
- To interfere with or disrupt the service or servers
- To impersonate any person or entity
- To collect or harvest personal information about other users
6. Data Collection and Privacy
6.1 Information We Collect
In order to provide our service, we collect and store the following information:

- Payment Tracking Data: Merchant/service names, payment amounts, due dates, payment frequencies, descriptions, and tags you create
- Partial Card Information: Bank or card issuer name and last four digits only (we do NOT store full card numbers, CVV codes, or expiration dates)
- Payment Method Information: Names and types of alternative payment methods (crypto, wire transfer, etc.)
- Usage Data: Service interaction data, feature usage, and analytics
6.2 How We Use Your Information
We use your information to:
- Provide and maintain the service
- Send payment reminder emails
- Generate calendar exports
- Improve and optimize the service
- Communicate with you about your account
- Detect and prevent fraud or abuse
6.3 Third-Party Services
We use the following third-party services that may collect data:
- Resend: Email delivery service for sending reminder notifications
- Google Analytics: Anonymous usage analytics to improve the service
- Currency Exchange Rate APIs: Real-time currency conversion data

7. Email Communications

7.2 Email Delivery Disclaimer
IMPORTANT: We cannot guarantee that emails will be delivered to your inbox. Email delivery may fail due to:
- Spam filters or email provider restrictions
- Incorrect email addresses
- Third-party email service outages
- Network or technical issues
- Full mailbox or storage limitations
You are responsible for checking your spam/junk folders and ensuring our emails can reach you. We are NOT liable for missed payments due to undelivered emails.
7.3 Opting Out
You may opt out of certain non-essential emails. However, you cannot opt out of critical account-related communications without closing your account. Payment reminders are a core function of the service; disabling them may reduce the service's usefulness.
8. Calendar Export Feature
8.1 Calendar URL Security
Our calendar export feature generates a unique, tokenized URL that allows calendar applications to access your payment schedule. This URL contains a security token that grants access to your payment data.
You are solely responsible for:
- Keeping your calendar URL private and secure
- Not sharing your calendar URL with unauthorized parties
- Understanding that anyone with the URL can view your payment information
- Regenerating your calendar URL if it becomes compromised
8.2 Calendar Access Revocation
We reserve the right to revoke or regenerate calendar access URLs at any time for security purposes. You can also regenerate your own calendar URL through your account settings.
9. Payment Information and Security
9.1 Limited Information Storage
NextPayments.cc is designed with privacy in mind. We do NOT collect or store:
- Full credit or debit card numbers
- Card CVV/CVC security codes
- Card expiration dates
- Card PINs
- Online banking credentials
We only store the bank/issuer name and last four digits of your cards for identification purposes.
9.2 Not a Payment Processor
We are NOT a payment processor, financial institution, or money transmitter. We do not:
- Process payments on your behalf
- Have access to your payment accounts
- Transfer or hold funds
- Require PCI-DSS compliance (we don't handle full card data)
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Accuracy: We do not warrant that the information in our service is accurate, reliable, or correct
- Availability: We do not warrant that the service will be uninterrupted, timely, or error-free
- Email Delivery: We do not warrant that reminder emails will be delivered or received
- Results: We do not warrant that use of the service will prevent missed payments or unwanted charges
- Security: We do not warrant that the service will be free from viruses, security breaches, or unauthorized access
- Fitness for Purpose: We do not warrant that the service will meet your specific requirements or expectations
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTPAYMENTS.CC SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER ARISING FROM YOUR USE OF THE SERVICE.
11.1 Scope of Limitation
IN NO EVENT SHALL NEXTPAYMENTS.CC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:
- Missed Payments: Any missed payments, late fees, penalties, or interest charges resulting from your failure to make timely payments
- Undelivered Reminders: Damages resulting from undelivered, delayed, or failed email reminders
- Incorrect Information: Damages resulting from incorrect, incomplete, or outdated payment information you entered
- Unwanted Charges: Charges from subscriptions you intended to cancel but did not
- Service Interruptions: Damages resulting from service downtime, maintenance, or unavailability
- Third-Party Failures: Damages resulting from third-party service failures (email providers, currency APIs, etc.)
- Data Loss: Loss of data due to technical failures, breaches, or account termination
- Security Breaches: Unauthorized access to your account or data
- Currency Conversion Errors: Inaccuracies in currency exchange rates or conversions
11.2 Types of Damages Excluded
THIS LIMITATION APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:
- Direct, indirect, incidental, or consequential damages
- Special, exemplary, or punitive damages
- Loss of profits, revenue, or business opportunities
- Loss of data or information
- Loss of goodwill or reputation
- Personal injury or property damage
11.3 Cap on Liability
IF, NOTWITHSTANDING THE FOREGOING EXCLUSIONS, WE ARE FOUND LIABLE FOR ANY DAMAGE OR LOSS, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF:
- (A) The amount you paid to us (if any) in the 12 months preceding the claim, OR
- (B) One hundred U.S. dollars (US $100.00)
11.4 Essential Terms
You acknowledge that these limitations of liability are essential elements of the agreement between you and NextPayments.cc, and that we would not provide the service without these limitations.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
12. Third-Party Services
12.1 Third-Party Dependencies
Our service relies on third-party services for certain functionality:
- Resend: Email delivery infrastructure for reminder notifications
- Google Analytics: Website analytics and usage statistics
- Currency Exchange APIs: Real-time currency conversion data
- Content Delivery Networks: CSS frameworks and other assets
12.2 No Control Over Third Parties
We do not control third-party services and are not responsible for:
- Their availability, reliability, or performance
- Their privacy practices or data handling
- Changes to their services or terms
- Their security or data breaches
12.3 Third-Party Terms
Your use of third-party services through our platform may be subject to their own terms and conditions. We encourage you to review the terms and privacy policies of any third-party services.
13. Intellectual Property
13.1 Our Rights
All content, features, and functionality of the service, including but not limited to:

- Design, layout, and user interface

are owned by NextPayments.cc or our licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the service for your personal, non-commercial use, subject to these Terms.
13.3 Your Content
You retain ownership of any data or content you submit to the service. By submitting content, you grant us a worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing the service.

16.3 Effect of Termination

18. Dispute Resolution

18.2 Binding Arbitration
If the dispute cannot be resolved informally within 30 days, you agree that any dispute shall be resolved through binding arbitration in accordance with the rules of a mutually agreed-upon arbitration service, rather than in court.

You agree to resolve disputes with us on an individual basis and waive your right to participate in any class action, representative action, or consolidated proceeding against us.
18.4 Exceptions
Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.
Note: Some jurisdictions do not allow mandatory arbitration or class action waivers. If you reside in such a jurisdiction, these provisions may not apply to you.
19. Miscellaneous Provisions

These Terms, together with our Privacy Policy and any other legal notices published by us on the service, constitute the entire agreement between you and NextPayments.cc concerning the service.
19.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
19.3 No Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver shall be effective unless made in writing and signed by an authorized representative of NextPayments.cc.

You may not assign or transfer these Terms or your rights and obligations under these Terms without our prior written consent. We may assign these Terms and our rights and obligations without restriction.
19.5 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
19.6 Relationship of Parties
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and NextPayments.cc. You have no authority to bind us or make commitments on our behalf.
19.7 Headings
The section headings in these Terms are for convenience only and have no legal or contractual effect.
19.8 Language
These Terms may be translated into other languages for your convenience. In the event of any conflict between the English version and a translated version, the English version shall prevail.
